ENVIRONMENTAL LEGISLATION CHANGES

These Regulations amend the Environmental Offences (Fixed Penalties) (England) Regulations 2017 and the Environmental Protection Act 1990. This instrument will allow local authorities greater freedom to set fixed penalty levels for certain environmental offences in line with their local enforcement strategies and priorities. If an authority does not a set a fixed penalty notice (FPN) level, then the pre-existing default level will still apply. These Regulations relate to the implementation of the Nature Restoration Fund (NRF). The NRF is established by Part 3 of the Planning and Infrastructure Act 2025 (the Act) and is an alternative approach for developers to meet certain environmental obligations relating to protected sites and species.  This instrument sets out the framework by which the nature restoration levy (the levy), which funds the NRF, operates. These Regulations close the Northern Ireland Non-Domestic Renewable Heat Incentive Scheme (‘NIRHI’, or ‘the Scheme’) and introduce annual closure payments, based on deemed heat output using historical data (2017–2019), to eligible participants for the remainder of their original 20-year accreditation period.
